2Conveyancing Diligence & Legal Disclaimers

Property transactions carry material financial risk. Users and their clients must always retain qualified conveyancing solicitors and chartered surveyors prior to exchange of contracts.

3Statutory Data Sources & Accuracy

Our reports are compiled directly from open statutory datasets published under the Open Government Licence (OGL v3.0) and authoritative UK public sector databases, including:

• HM Land Registry: Price Paid transaction data and registered transfer records;
• Environment Agency & Natural Resources Wales: RoFSW surface water, river, and sea flood risk models;
• British Geological Survey (BGS): GeoSure natural ground stability and shrink-swell hazard data;
• UK Health Security Agency (UKHSA): Indicative radon potential atlas (1km grid classification);
• DEFRA: National ambient air quality monitoring network;
• Historic England & Cadw: National Heritage List for England (NHLE) listed buildings and monuments;
• UK Police Data Services: Police.uk neighbourhood crime and disorder statistics.

While we update feeds regularly from official endpoints, public sector registers are subject to periodic reporting intervals, local council upload delays, and administrative recording latencies. We provide data on an “as is” and “as available” basis without warranties of completeness or immediate real-time synchronization.

4Accounts, Free Quotas & Fair Usage

Free users are entitled to up to 5 complete property diligence reports. Accessing reports beyond the complimentary allocation requires an active paid subscription plan.

You agree to use the service only for lawful property diligence purposes. You agree not to:

• Use automated scripts, web crawlers, bots, or scrapers to extract bulk property records or replicate our platform database;
• Circumvent or attempt to tamper with search quotas, authentication tokens, or rate-limiting mechanisms;
• Share user credentials across multiple individuals outside the seat limit of your selected subscription tier;
• Overburden, disrupt, or launch denial-of-service attacks against our API infrastructure or server endpoints.

5Subscriptions, Payments & Cancellations

• Subscription Plans: We offer monthly recurring plans, including Starter (£49/month) and Teams (£149/month), each unlocking unlimited report generation and premium features as detailed on our Pricing Page.
• Payment Processing: All transactions are processed securely via Stripe. By entering payment credentials, you authorise recurring monthly charges until cancellation.
• Cancellation: You may cancel your subscription at any time via your self-service Stripe Customer Portal or by contacting support. Your access will remain active until the end of your current prepaid billing cycle, after which no further recurring charges will be made.
• Refunds: Because statutory search queries consume real-time computing and public register API resources immediately upon generation, subscriptions are generally non-refundable once reports have been generated, except where statutory UK consumer cancellation rights apply or where required by law.

6Corporate Branding & White-Label Exports

Subscribers utilizing the custom letterhead and white-label export functionality are permitted to present generated diligence briefs to prospective clients, investors, or mortgage applicants under their own practice branding.

You warrant that you hold all necessary trademarks, copyright permissions, and corporate authorisations for any logos, trading names, or brand assets you upload to the platform. You agree to indemnify Property Due Diligence against any third-party claims arising from unauthorized branding uploads.

7Limitation of Liability

To the fullest extent permitted by English law, Property Due Diligence and its directors, employees, and data suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of business opportunities, or abortive acquisition costs arising from reliance on platform records.

Our total aggregate liability under or in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall be strictly capped at the total amount paid by you to Property Due Diligence in the twelve (12) months preceding the claim.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under the laws of England and Wales.

8Governing Law & Jurisdiction

These Terms, their subject matter, and their formation are governed by the laws of England and Wales. You and Property Due Diligence both agree that the courts of England and Wales will have exclusive jurisdiction in relation to any dispute or claim arising under these Terms.
